Terms and Conditions of Use of Sugar Daddy Planet

Welcome to Sugar Daddy Planet (hereinafter, “the Platform”, “the Website” or “Sugar Daddy Planet”), accessible at sugardaddyplanet.com. These Terms and Conditions (hereinafter, “the Terms”) govern access, registration and use of the services offered on the Platform.

Accessing, registering or using any service of Sugar Daddy Planet implies the full, express and unreserved acceptance of each and every clause set out herein. If you do not agree with any provision, please refrain from using the Platform.

1. Purpose and description of the service

Sugar Daddy Planet is a private social network designed to put adult users in contact with each other, who are interested in establishing mutually agreed relationships within the “sugar” lifestyle. The Platform offers, among other services:

Creation of a personal profile with photographs and description.
Search and viewing of other users’ profiles.
Private messaging between subscribed users.

Sugar Daddy Planet does not act as a dating agency, escort service, or intermediary in any kind of financial transaction between users. The Platform is exclusively a communication space. Any agreement, meeting or relationship between users is the sole responsibility of the parties involved.

2. Access and registration requirements

In order to register and use the Platform, the user must:

Be of legal age (18 years or the age of majority established in the user’s country of residence, if higher).
Have full legal capacity to enter into a contract.
Provide truthful, up-to-date and complete information during the registration process.
Expressly accept these Terms and the Privacy Policy.

The user is responsible for safeguarding their access credentials (email and password) and for all activity carried out from their account. Sugar Daddy Planet reserves the right to suspend or cancel any account that fails to comply with these requirements or that shows signs of impersonation, falsehood or fraudulent use.

3. Subscription plans and prices

Sugar Daddy Planet offers different access modalities:

Free access: allows users to view profiles and read the forum, with no possibility of sending private messages or posting in the forum.
Monthly access: full access to the social network, including private messaging and forum posting, during the contracted monthly period, automatically renewable.
Quarterly access: full access for three months, automatically renewable.
Annual access: full access for one year.

The prices in force at any given time will be displayed at the payment gateway before confirming the subscription. The amounts include applicable taxes, unless expressly stated otherwise.

3.1 Automatic renewal

Monthly and quarterly subscriptions are automatically renewed through PayPal’s subscription system. Cancellation of the renewal must be made directly from the user’s PayPal account, since recurring payments are managed by PayPal.

There is no minimum commitment period. The user may cancel the renewal at any time; future periods will not be charged, but the period already paid and currently in progress will not be refunded.

3.2 Promotions and discounts

Sugar Daddy Planet may offer occasional discounts through the homepage of the website or through newsletters. These promotions may be addressed to new users or to specific users without this entailing any compensation, discount or equivalent right for the rest of already registered users.

4. Payment methods

Payments are made exclusively through PayPal, which acts as a secure payment gateway. Sugar Daddy Planet does not store any banking or credit card information of the user at any time; all financial information is managed by PayPal in accordance with its own terms and privacy policy.

5. Right of withdrawal

In accordance with article 103.a) of Royal Legislative Decree 1/2007 of November 16, approving the consolidated text of the General Law for the Defense of Consumers and Users:

“The right of withdrawal shall not apply to the provision of services, once the service has been fully executed, when execution has begun with the consumer’s prior express consent and with their acknowledgment that they are aware that, once the contract has been fully performed by the trader, they will have lost their right of withdrawal.”

Consequently, at the moment the user makes their first paid access to the Platform and uses (or has the possibility of using) the private messaging service, they will lose their right of withdrawal with respect to the period in progress, since the service is deemed to have been fully performed.

If the user does not wish to continue using the service, they must cancel the subscription from their PayPal account, thus avoiding future renewals.

The user may request any information they deem appropriate before registering on the Platform through the contact area. Under no circumstances will refunds be made of monthly, quarterly or annual amounts already paid.

6. User conduct policy

Use of Sugar Daddy Planet implies the user’s commitment to behave with respect, legality and good faith. Failure to comply with the following rules will result in immediate expulsion from the Platform without the right to a refund, without prejudice to any legal action that may apply.

The user expressly undertakes to:

Not make illegal or immoral use of the contents offered.
Not capture, download or take screenshots of content posted on other users’ profiles.
Maintain the confidentiality of content, conversations and opinions of other users, and not distribute them outside the Platform.
Not attack, manipulate or alter the operation of the website by any means (DDoS attacks, reverse engineering, scraping, etc.).
Not insult, slander or disrespect other users, creators, administrators, designers or programmers of Sugar Daddy Planet. Any xenophobic, racist, homophobic or discriminatory comment will be grounds for immediate expulsion.
Not promote scams, pyramid schemes or any fraudulent content contrary to good practices.
Not use the Platform to engage in prostitution or to offer sexual services in exchange for money. Sugar Daddy Planet is a social networking platform for connections, not a platform for sexual services.
Not impersonate another person or use third-party photographs without their consent.
Not request money transfers, gifts or any goods from other users under deceptive pretexts.
Not post sexually explicit content or pornography in profiles or in the forum.
Respect the intellectual property of content posted by other users and by the Platform.

Sugar Daddy Planet reserves the right of admission throughout the entire process, including the trial period, and may expel any user in case of detecting suspicious, recidivist, offensive or otherwise non-compliant behavior.

The opinions, conversations and files shared within Sugar Daddy Planet may not leave the Platform, be quoted, referenced or communicated outside the social network or the channels enabled for that purpose (email notifications).

7. Forum rules

The forum is a moderated discussion space. The following rules apply:

Contact ads are not allowed in the forum; that is what the social network is for.
Any attack on the website, its administrators or moderators will be grounds for expulsion.
Erotic or pornographic content is not allowed in the forum.
Advertising of websites that do not provide relevant information or that harm the competitiveness of Sugar Daddy Planet is not allowed.
Repeated, duplicate posts or spam are not allowed.
Obscene, distasteful or illegal messages are not allowed.
It is strictly forbidden to post links to illegal content, pirated software, serial numbers or any material that infringes copyright.
Users who disrupt the proper functioning of the forum through repeated complaints, disrespect moderators or breach these rules, will be sanctioned or expelled according to the severity. Complaints about moderation tasks must be made privately to the corresponding moderator and, if no response is obtained, must be reported to the webmaster or administrators. Administrators and moderators are the ones who determine the admissibility of messages.
Every user has the right to report any breach of the forum rules to the webmaster, administrators or moderators, who will take the appropriate measures.

8. Intellectual and industrial property

All Sugar Daddy Planet content (design, source code, logos, trademarks, texts, images, videos, databases, etc.) is the property of Sugar Daddy Planet or is used with the corresponding authorization, and is protected by current legislation on intellectual and industrial property.

9. Electronic newsletters and communications

Registration on Sugar Daddy Planet implies express consent to receive email communications regarding:

Notifications of new messages or interactions on the social network.
Notifications of forum subscriptions or contact attempts.
Information about contracted services or similar products.
Informational and promotional newsletters.

The user may unsubscribe from promotional communications at any time using the link included at the bottom of each email. However, even after unsubscribing from promotional communications, we may continue to contact the user for transactional matters relating to their subscription and purchases.

10. Voluntary privacy configuration

The user is free to provide or not provide personal information in their profile, as well as to modify or delete it manually from their account.

11. Security and data processing

Users are protected by European (Regulation (EU) 2016/679 — GDPR) and Spanish (LOPDGDD) data protection regulations. In accordance with such regulations, the user may exercise at any time their rights of:

Access to their data.
Rectification of inaccurate data.
Erasure (“right to be forgotten”).
Restriction of processing.
Objection to processing.
Portability of data to a third party.

12. Contests and promotions

13. Forums and public areas

The Platform includes areas where users may post information, communicate with others, comment, etc. All information posted in these areas may be accessible to any registered user, except for private messages between users.

If you post your email address along with a public comment, you may receive unwanted messages. We strongly recommend not to post personal data, whether your own or that of third parties. Management of such data is the user’s responsibility; Sugar Daddy Planet does not manage personal data not previously requested.

14. Refunds and returns

Due to the nature of the service (access to a social network with content and communication immediately available), Sugar Daddy Planet does not issue refunds or cancellations with reimbursement of amounts already paid. The Platform’s obligation is considered fulfilled from the moment access to the service is granted to the user, regardless of the actual use the user makes of it.

This rule is non-appealable, except in the exceptional case where the user has not activated the paid subscription on the Platform and has had no access to private messaging or the possibility of sending private messages (the mere possibility of sending messages is understood to constitute access to paid content). This circumstance must be evidenced by the user.

Sugar Daddy Planet also reserves the right of admission, and may expel a user if their behavior is inappropriate or recidivist, if they make accusations against the Platform, its content or those responsible, or if they pose a threat. In such cases, no refund will be issued.

The user agrees that the payment made grants the right to the possibility of accessing the private messaging service for the contracted period, not the actual sending of a specific number of messages. The service is deemed provided by merely making it available.

15. Limitation of liability

Sugar Daddy Planet acts solely as a provider of a communication space. Consequently, it shall not be held responsible for:

The truthfulness, accuracy or legality of content, profiles or information posted by users.
The relationships, agreements, meetings or transactions that users may establish with each other, whether inside or outside the Platform.
Damages or losses arising from interruptions, viruses, technical failures or external attacks on the website, without prejudice to the adoption of reasonable security measures.
Fraudulent or improper use of the Platform by third parties.

The user acknowledges that they use the Platform at their own and exclusive risk.

16. Modifications to the Terms

Sugar Daddy Planet reserves the right to modify these Terms at any time in order to adapt them to new legal, jurisprudential, technical or operational developments. Modifications will be published on this same page and will enter into force upon publication. Users are advised to review this section periodically.

Continued use of the Platform after the publication of modifications shall constitute tacit acceptance thereof.

17. Dispute resolution, applicable law and jurisdiction

The relationship between Sugar Daddy Planet and the user is governed by applicable Spanish and European law.

For any dispute arising from the interpretation or execution of these Terms, the parties submit, with express waiver of any other jurisdiction, to the courts of the consumer’s domicile when acting as such, in accordance with consumer protection regulations.

Likewise, in accordance with article 14.1 of Regulation (EU) 524/2013, the user is informed of the existence of the European Online Dispute Resolution platform, available at: https://ec.europa.eu/consumers/odr.

18. Partial nullity

If any clause of these Terms is declared null or unenforceable by a competent authority, the remaining clauses shall remain in full force and effect, and the whole shall be interpreted in the manner that best reflects the original will of the parties.
