Polaris Nexus LLC (“we”, “our”, “us”), operator of the website sugardaddyplanet.com (“the Platform”), respects the intellectual property rights of others and expects its users to do the same.<\/p>\n\n\n\n

This DMCA Policy describes how copyright owners (or their authorized agents) can notify us of allegedly infringing material on the Platform, and how affected users can respond. It is based on the procedures established by the United States Digital Millennium Copyright Act, 17 U.S.C. \u00a7 512<\/strong> (“DMCA”).<\/p>\n\n\n\n

3. How to file a DMCA notice of claimed infringement<\/h2>\n\n\n\n

If you are a copyright owner, or are authorized to act on behalf of one, and you believe that content available on the Platform infringes your copyright, you can send us a written notice of claimed infringement.<\/p>\n\n\n\n

To be effective under the DMCA, your notice must include all of the following<\/strong>:<\/p>\n\n\n\n

  1. A physical or electronic signature<\/strong> of a person authorized to act on behalf of the owner of the copyright that is allegedly infringed.<\/li>\n\n\n\n
  2. Identification of the copyrighted work<\/strong> claimed to have been infringed (or, if multiple works at one site are covered by a single notice, a representative list of such works).<\/li>\n\n\n\n
  3. Identification of the material<\/strong> that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or disabled, with information reasonably sufficient to permit us to locate the material<\/strong> \u2014 for example, the URL of the page where the content appears, the username, or the message identifier.<\/li>\n\n\n\n
  4. Information reasonably sufficient to permit us to contact you<\/strong>, such as an address, telephone number and (if available) an email address.<\/li>\n\n\n\n
  5. A statement that you have a good faith belief<\/strong> that use of the material in the manner complained of is not authorized<\/strong> by the copyright owner, its agent, or the law.<\/li>\n\n\n\n
  6. A statement that the information in the notice is accurate<\/strong>, and under penalty of perjury<\/strong>, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.<\/li>\n<\/ol>\n\n\n\n

    Please note:<\/strong> Under 17 U.S.C. \u00a7 512(f), any person who knowingly materially misrepresents<\/strong> that material is infringing, or that material was removed by mistake, may be subject to liability for damages<\/strong>, including costs and attorneys’ fees.<\/p>\n\n\n\n

    4. What happens after we receive a notice<\/h2>\n\n\n\n

    When we receive a complete notice that complies with Section 3, we will:<\/p>\n\n\n\n

    1. Acknowledge receipt<\/strong> of the notice.<\/li>\n\n\n\n
    2. Review<\/strong> the notice for completeness and apparent validity.<\/li>\n\n\n\n
    3. Remove or disable access<\/strong> to the allegedly infringing material expeditiously.<\/li>\n\n\n\n
    4. Notify the user<\/strong> who uploaded the material, where reasonably possible, and provide a copy of the notice.<\/li>\n\n\n\n
    5. Keep a record<\/strong> of the notice and the action taken, for the application of our Repeat Infringer Policy and for compliance with the DMCA.<\/li>\n<\/ol>\n\n\n\n

      If your notice is incomplete or unclear, we may request additional information before acting. Incomplete notices may not result in any action.<\/p>\n\n\n\n

      5. Counter-notification<\/h2>\n\n\n\n

      If you are a user whose content has been removed or disabled pursuant to a DMCA notice, and you believe in good faith that the removal was the result of a mistake or misidentification, you can file a counter-notification<\/strong>.<\/p>\n\n\n\n

      To be effective under 17 U.S.C. \u00a7 512(g), your counter-notification must include all of the following<\/strong>:<\/p>\n\n\n\n

      2. Identification of the material<\/strong> that has been removed or to which access has been disabled, and the location<\/strong> at which the material appeared before removal.<\/li>\n\n\n\n
      3. A statement under penalty of perjury<\/strong> that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.<\/li>\n\n\n\n
      4. Your name, address and telephone number<\/strong>.<\/li>\n\n\n\n
      5. A statement that you consent to the jurisdiction<\/strong> of the Federal District Court for the judicial district in which your address is located, or \u2014 if your address is outside of the United States \u2014 for any judicial district in which Polaris Nexus LLC may be found, and that you will accept service of process from the person who provided the original DMCA notice or an agent of such person.<\/li>\n<\/ol>\n\n\n\n
